Welcome to JewelryCadOnDemand.com (the “Website”), operated by M/s Meevira and M/s Intriguity that has its head office at 101, Jayshree Akshaya, IC Colony, Borivali (W), Mumbai 400103. (“Company,” “we,” “us,” or “our”). By using our Jewelry CAD design services (“Services”), you (“Customer,” “you,” or “your”) agree to the following Terms and Conditions. Please read them carefully.
1. Scope of Services
We provide Jewelry CAD design services based on sketches, drawings, or reference images provided by our customers. Our services include the conversion of 2D concepts into 3D CAD models, which are then delivered to the customer in a digital format.
2. Customer Responsibility for Design Ownership & Copyright
(a) By submitting any designs, sketches, images, or other materials to us, you represent and warrant that you own all rights to the provided designs or have obtained the necessary permissions or licenses to use them for jewelry CAD modeling.
(b) We do not conduct independent verification of design ownership or copyright status although we reserve the right to request proof of ownership or permission at our discretion. The responsibility for ensuring that any submitted design does not infringe upon third-party copyrights, trademarks, or intellectual property rights rests solely with the customer.
3. Indemnification
You agree to indemnify, defend, and hold harmless [M/s Meevira and M/s Intriguity], its owners, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:
- Any copyright, trademark, patent infringement claims or intellectual property infringement claims related to designs provided by you.
- Any disputes or legal actions initiated by third parties arising from the designs provided by you.
- Any misuse, modification, or production of the CAD designs that result in legal consequences.
4. Limitation of Liability
(a) We are not liable for any direct, indirect, incidental, or consequential damages resulting from the use of our CAD models, including but not limited to loss of profits, legal disputes, or production defects.
(b) In no event shall our total liability exceed the amount paid by the customer for the specific CAD design service in question.
5. Confidentiality
We respect the confidentiality of your designs and will not share, sell, or distribute your design files to third parties without your consent, except as required by law. However, only for generic jewelry designs we may share them on our social media handles to showcase our work and incase you find this not acceptable, pls let us know on info@jewelrycadondemand.com and we will ensure it is removed.
6. Revisions & Modifications
(a) We offer a limited number of revisions as part of our service. Additional revisions may be subject to extra charges.
(b) Once a final CAD file is delivered, any further modifications will be treated as a new project.
7. Amendments
We reserve the right to update or modify these Terms and Conditions at any time. Customers will be notified of significant changes through our website.
8. Liability
We are not liable for any business losses incurred by the customer due to our design, and our responsibility is limited solely to the amount charged for the CAD design service.
9. Data leakage
We are not responsible for any data leakage that may occur due to digital discrepancies or employee misconduct. However we do have checks and balances in place including an agreement with our employees and IT infrastructure to ensure all our data is protected. We implement reasonable security measures but do not guarantee absolute protection
10. Governing Law & Jurisdiction
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of India. Any disputes shall be resolved in the courts of the Republic of India.
